Shoulder injury

There are many different types of personal injury one of which one of which is to the shoulder and depending on what type of injury you have sustained they can take weeks or even months to heal.  In fact some people will find their shoulder injury never completely heals even after having extensive treatment.  This is not always the case and the prognosis will depend on the exact shoulder injury suffered.

Common shoulder injury examples range from inflammation, dislocation, frozen shoulder, torn ligaments, and can be as severe as major nerve damage which can affect the neck as well.

Can I make a claim for compensation?

If your shoulder injury was caused by the fault of someone else, you may be able to take legal action against the responsible party for compensation.  There are basic guidelines outlining personal injury settlement averages.  The table below is an example of the level of compensation that may be awarded for a shoulder injury.

In addition to the above, you may be able to claim compensation for any loss of earnings, expenses and costs incurred as a result of the accident. 

If you have sustained a personal injury which was caused by the negligence of someone else, you will need to consider how you are able to fund a personal injury claim against the person or persons responsible.  The first thing you will need to do is check your basic homeowners insurance policy to see if you have any legal expenses cover included under the policy.

Most basic homeowners insurance policies will provide legal expenses cover and will state somewhere in the policy the exact level of indemnity offered under that specific homeowners insurance policy. 

You may think just because you have purchased basic homeowners insurance you will not have legal expenses cover but you will find that even the most basic homeowners insurance will afford some extra legal expenses cover.  You should check your policy and contact your legal expenses provider to initiate a claim.

What will I have to do to make a personal injury claim under my basic homeowners insurance policy?

The normal procedure is to request a claims form to be sent to you.  Once you have received this form, you will need to fill it in as accurately as possible.  It is a good idea to write a statement detailing exactly what happened leading up to your injury.  If there were any witnesses, see if you can ask them to write a short statement about what they saw.  If you are able to it is also a good idea to take regular photographs of your injury.  You can then send copies of the photographs with the claim form.

Once the homeowners insurer has received your claim form they will decide whether or not they believe you have grounds for a personal injury claim.  If they believe that you have, they will normally agree to fund a solicitor to act on your behalf which should be covered under your basic homeowners insurance.
